The recent announcement that paragraph 395C of the Immigration Rules is to be scrapped raises questions about the significance for long term overstayers, human rights claims and rights of appeal following the Sapkota case. The associated guidance in Chapter 53 of the Enforcement and Guidance Instructions could be rendered redundant by the change. It may also mark the end of the Legacy backlog clearance exercise, which was at least purportedly based on rule 395C.
