This module will assist you to understand the human rights law as it affects the establishing of claims for international protection in the United Kingdom. The course covers the legal operation of human rights in immigration and asylum proceedings, and examines Articles 3 and 8 of the European Convention on Human Rights in depth, as well as touching on the other ECHR rights. There is a detailed discussion of proportionality as it applies in human rights cases. Finally, the course examines human rights and immigration status and travel documents.
The course is at intermediate to advanced level. It is a comprehensive guide to human rights arguments in immigration and asylum cases but is designed to be accessible to practitioners with little prior knowledge of human rights law. The course includes material that would be of interest to an advanced level practitioner, for example on the case law surrounding Article 3 and 8 of the ECHR.
At the end of the course you should be familiar with how human rights operate in practice in immigration and asylum proceedings and how to advance arguments to resist removal on human rights grounds.

This module states the law as at summer 2010, when the immigration manual on which the course is based was last updated. Immigration law can change rapidly, so the materials may now not reflect the latest position in places
