The new European Court of Justice case of Zambrano represents a radical departure away from previous case law and understanding of European free movement law and towards a new concept of European citizenship rights. For the first time the ECJ held that all citizens of Member States have a right to 'the genuine enjoyment of the substance of the rights attaching to the status of European Union citizen'. Movement across borders is unnecessary, as is economic activity of any sort. This has wide implications for cases involving British children but may also offer new arguments in spouse and dependent relative cases. The case raises many questions, which this workshop course offers an opportunity to discuss and think through. For example, can a British citizen elect to make use of EC law family unity provisions rather than the domestic immigration rules? What is the legal status of a person who secures a right of residence and work permit through Zambrano but outside the Citizens Directive? What sort of factual scenarios might arise in the UK where Zambrano might be relevant?
