Preventing removal: urgent cases
Urgent removals and Rule 39 challenges are becoming more and more common but also more complex. With the relationship between UKBA and the Administrative Court being called into doubt and new previously secret policies being exposed on removals to Sri Lanka and no-notice removals, now is a good time to be reviewing the process, procedure, strategy, tactics and law on urgent removals cases.

Long residence: rules, cases and new policies
DP3/96 and the seven year rule for children may have been scrapped but human rights arguments can fill the void. Azhar looks at new case law on long residence and also the new 2008 policies on long residence for failed asylum seekers and the new policy on discretion to overlook short gaps in lawful residence under the ten year rule.

Refugee spouses and their families: getting Entry Clearance
Edward has been granted permission to appeal to the House of Lords in ZN (Afghanistan) [2008] EWCA Civ 1420. He will talk on whether British citizens and family members of refugees can use the refugee family reunion rules, whether those who themselves entered as family members of refugees can use the rules (the tribunal say not in MS (Somalia) [2009] UKAIT 00041) and will also look at A (Afghanistan) [2009] EWCA Civ 825 and the position of new spouses of refugees with only limited leave.

Further fresh claim submissions in asylum cases: the new rules
All further representations now supposedly have to be made in person in Liverpool, as of October 2009, and a new further submissions form has been designed by UKBA. The new rules have caused consternation and confusion. The trainer will look at how the new rules are working so far, whether they can be sidestepped and what the implications are when it comes to further representations, fresh claims and removals.
