This course gives an overview of issues arising in the very topical area of appeals against “conducive to the public good” deportations, including those relevant to individuals who have committed criminal offences. We address: the statutory, immigration rule and policy framework; tactics and the role of factors including the views of the sentencing judge and the Probation Service, and the danger of re-offending.

We also address: the latest Strasbourg case law and the relevance of family life issues; the impact of criminal offences on an appeal on refugee grounds; European Community law cases.

Finally, we give an overview of issues arising from the detention of foreign national prisoners, such as spotting unlawful detention, and addressing the latest case law on detention and access to justice.

This course assists delegates in drafting grounds that have a good prospect of success in obtaining reconsideration of an asylum or immigration appeal; knowing what procedures the AIT are following at the “reconsideration” stage; understanding when fresh evidence can be submitted at a reconsideration hearing; understanding the difference between review and reconsideration, and between first and second stage reconsideration; applications to, and appeals in, the Court of Appeal.

We also address issues of public funding.

This course aims to familiarise practitioners with the statutory framework for reconsideration and onward appeals, The Asylum and Immigration Appeals (Procedure) Rules 2005 and relevant amendments to them, and with Practice Directions made under them, including the changes brought in by DK Serbia and AH Sudan. We pay particular attention to common defects in decision making that are likely to be challengeable, and demonstrate how to analyse determinations to establish whether errors of law and errors of fact are present, with a view to coaching delegates on how to identify whether a decision of the AIT can be challenged.

The purpose of this course is to provide a practical overview of key issues in relation to the provision of benefits and support for persons subject to immigration control. As is well known, this area of law is extremely fast moving and relatively involved. The course will therefore focus on current matters of concern to practitioners in relation to: eligibility for social security benefits, support under NASS (including dispersal issues); support under Community Care legislation (with a focus on the developing law in relation to S21 NAA 1948); support for unaccompanied minors (with a particular focus on age dispute cases); support under S4 of the 1999 Act as amended (focus on fresh claims and failed asylum seekers unable to return to their countries of origin); exclusion from support under Schedule 3 (particularly ECHR and Community Treaty rights implications of such withdrawal).

This course will end with a discussion on case studies considering some of the areas covered.
