This conference gives an update on critical areas of practice for all those working in the field of immigration law, both practitioners and decision makers.

The morning session begins with a discussion of latest developments in asylum and human rights law, including armed conflict and family life in the light of the landmark House of Lords decisions of Summer 2008. It moves on to an update on European Community free movement law, addressing evolving developments in the Tribunal, higher courts and European Court of Justice.

The afternoon session starts off with a tour of developments both in the immigration rules themselves and the case law that interprets them, ranging from “third party” rights to the evolving law on deportation of foreign criminals.

We finish off with a look ahead to the new era that awaits us in 2009, with the wholesale abolition of existing immigration law and its replacement by the provisions of the Immigration and Citizenship Act. Meanwhile The Tribunals Courts and Services Act 2007 gives the government a chance to end the days of reconsideration and review, and to introduce a jurisdiction to consider judicial reviews in a new Upper Immigration Tribunal.

Our annual Judicial Review Conference took place on the 23rd January 2009.

We aimed to refresh the knowledge of practitioners regarding procedures, funding, and to address the latest substantive law developments in judicial review.

Experienced practitioners discussed funding and tactics, addressed recurring issues from urgent removal cases to interim relief and remedies, before moving on to address topical challenges to detention and country specific policies, and the European Community law of protection and exclusion from refugee status.
There was an update on legacy cases, in-country appeals, legitimate expectation, minors, and the approach to reviewing Home Office policies generally. The day concluded with a look at plans for the new Tribunal.

The conference was presented by leading practitioners in the Immigration and Asylum field and included David Jones, Mark Symes, (both tenants of Garden Court Chambers), Tim Buley (Landmark Chambers) and Hugh Southey (Tooks Chambers) and James Packer (Duncan Lewis Solicitors). The day was chaired by Richard Drabble QC of Landmark Chambers.
